Wills and the documents that contribute to the process of distributing the estate of an individual can be a wonderful source of information about the deceased, their family and those who survived.
The books in the Surrogate Court Index of Ontario, Canada 1859-1900 series are designed to assist researchers in finding death and estate information for those who died in Ontario from the middle to the end of the nineteenth century. Specifically, this index covers Estate Files dated between 1859-1900. The death may have occurred months or even years before the date that the estate was finalized. Many times the estate of the deceased may not have been settled until the death of a spouse.
Estate Files are of great interest because of the bounty of detailed information that they contain about the deceased, and about those who survive. The Surrogate Court used the documents in order to disperse the deceased's estate, whether he/she died with (testate) or without (intestate) a Will.
The contents of Estate Files can include:
- Petition for Probate (with Will) or Administration (without Will)
- Original Will
- Executors' or administrators' oaths
- Inventory of assets of the deceased
The index in this volume is organized alphabetically to make it easier to locate persons of interest, regardless of the date that the Estate File was registered.
Information in the Surrogate Court Index of Ontario, Canada 1859-1900 books include:
- Surname
- Given name/s
- Place of death
- Estate File number
- Year that the Estate File was registered
Some entries have additional information recorded in the index such as "infant' or other comments from the index compiler.

Originally published by Generation Press between 1988-1994, this Second Edition of the Surrogate Court Index of Ontario, Canada 1859-1900 was published by Global Heritage Press in 2005. This edition includes a new introduction and a map of Ontario with counties clearly outlined.
